I do not really sell baits and made this for fun. Not any money to be made for the amount of time put in. It's mainly for friends and to keep me busy. I end up giving away more than I sell :)

Honestly, the red hurts my eyes with the yellow text. White text might be easier on the eyes. Course, my old eyes are straining to type this!!!!!!!!!!!!! ; ;D  ;D  ;D

Just a heads up Bill......You may want to take the "Trick Worm" name off of your shakey worm page when you get a chance.

If not, you may receive a threatening Cease and Desist letter from Zoom as that is a trademarked name.

PS  Is that BT or Bear's mold? I love me some 6" shakey worms!!!!!!!!!

Thanks for the heads up. As I said, only a select few have this site address and i cant really advertise it.

The 3" Angry craw is an exact copy of the Rage craw, so I cant sell those either. That was a hard mold to get.

Monte, I looked at your craw and one of the Rage Craws and they'res similarities, but it isn't exact.   As long as you change the bait by 25% nobody can do anything about infringements or copy rights. That was the case between Reaction Innovations and Linmar molds and other companies that mimic Reaction Innovations product. Between your product and Strike Kings, in my opinion, there is a 25% difference. Take my word with a grain of salt because I have no expertise in detecting differences or similarities, but it doesn't take a rocket science to see difference.

I'm not a patent attorney, so consider the source here...

The issue is with the thickness of the claws on the outside and inside (that is what the patent covers).  It wouldn't matter if you changed it 100% if the claw dimensions fell withing their claim.

Now here's the real truth, a big company could kill a small company in a heartbeat with just legal fees.  It could be a claim without merit and you would still get buried unless you have a ton of money.

As far as personal use vs. selling them, the patent still applies.  They could come after someone for lost sales regardless.  I wouldn't think they would, but they are entitled to.

Remember, patents are not just on the way a bait looks also. Many companies patent the action a bait gives off. Most folks don't look at that portion of the patent.

Plus, the rage craw patent focuses is on the claw portion, not the full bait. They could easily win a suit comparing the baits in my opinion. The text on the web page even states the comparison...

As Jason stated, they could still sue you regardless if the bait infringes or not, make you defend yourself in court for hundreds of thousands.

I would not chance them making me an example!!!!
